By installing, accessing, or using Forge or any ShipToday service (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
If you do not agree to these Terms, do not use the Service.
Forge is an AI orchestration layer that connects to the AI development tools your team already uses (including but not limited to Claude, Cursor, and other AI development tools) and provides them with organizational context before generating output. The Service includes the Forge software, any associated APIs, the analytics dashboard, and the ShipToday website.
The Service is currently offered as a free plan for individual use. Paid team add-ons (for example, a Teams add-on) may be introduced in the future and will be described on our pricing page when available.
Use of the Service requires you to create an account with a valid email address. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at security@shiptoday.ai if you suspect unauthorized access.
You must be at least 18 years of age to use the Service.
Subject to these Terms, ShipToday grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes. This license does not include the right to sublicense, resell, or otherwise make the Service available to third parties.
You may not reverse engineer, decompile, or attempt to extract the source code of the Service.
You own your work. Source code, documents, tickets, and any other content you create or that exists within your connected tools remains entirely yours. ShipToday does not claim any ownership over your intellectual property.
Forge processes workflow metadata (task types, cycle counts, timing) to provide the analytics dashboard. This processing is covered in our Privacy Policy. We do not access, store, or use your source code or proprietary data for any purpose.
By using the Service you grant ShipToday a limited license to process your data solely as required to provide the Service.
You agree not to use the Service to:
ShipToday reserves the right to suspend or terminate accounts that violate these terms, at our sole discretion.
The Service is currently free for individuals. Any paid add-ons introduced in the future will be billed monthly in advance unless otherwise stated. All fees are stated in USD and are non-refundable except as required by law or as set out in Section 8.
You authorize ShipToday (or our payment processor) to charge your payment method on the billing date each month. If a payment fails, we will notify you and provide a grace period of 7 days before suspending access to paid features.
We may change pricing with 30 days' advance notice. Continued use of the Service after the notice period constitutes acceptance of the new pricing.
You may cancel your paid subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period — you will retain access to paid features until that date. We do not provide refunds for partial months.
If ShipToday terminates your account without cause, we will provide a pro-rata refund for any unused portion of your prepaid subscription.
The Service, including all software, design, text, graphics, and other content created by ShipToday, is owned by ShipToday and protected by intellectual property laws. Nothing in these Terms transfers any ShipToday intellectual property to you.
If you provide feedback, suggestions, or ideas about the Service, you grant ShipToday a perpetual, royalty-free license to use that feedback without restriction or compensation to you.
Forge integrates with third-party tools and services (such as Jira, GitHub, and AI providers). Your use of those services is governed by their own terms of service and privacy policies. ShipToday is not responsible for the practices of third-party services.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, SHIPTODAY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or completely secure. The AI outputs produced with Forge's assistance are provided for informational purposes — you are responsible for reviewing and validating all outputs before use.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHIPTODAY'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SHIPTODAY IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.
IN NO EVENT WILL SHIPTODAY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to indemnify and hold harmless ShipToday and its officers, directors, employees, and agents from any claims, damages, losses, or costs (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
Either party may terminate these Terms at any time. ShipToday may suspend or terminate your access immediately if you violate these Terms or if we are required to do so by law.
Upon termination, your right to use the Service ceases immediately. Sections 5 (your content), 9 (intellectual property), 11 (disclaimers), 12 (limitation of liability), and 15 (governing law) survive termination.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, United States.
We may update these Terms from time to time. We will notify you of material changes at least 14 days before they take effect by email (if you have an account) or by posting a notice on our website. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
